The Biden Administration must boldly act to designate and redesignate TPS protections

The Biden Administration has the authority to grant Temporary Protected Status (TPS) to eligible foreign-born immigrants residing in the U.S. who are unable to return home safely due to dangerous and unsafe conditions or circumstances.

TPS is essential for establishing a fair and humane immigration system. It’s a humanitarian protection program that will save the lives of foregin-born immigrants living in the U.S. whose countries are facing ongoing political, natural and other humanitarian crises. It keeps families and friends together without having to live through the fear of uncertainty and separation that many undocumented immigrants continue to face.

Tell President Biden and DHS Secretary Mayorkas to use TPS as a tool of compassion for foreign born migrants living in the U.S. 

Unlike immigration legislation, TPS designation is granted solely by the President and his administration. The Department of Homeland Security, in consultation with the State Department, has the independent authority to make TPS designations under section 244 of the INA and given full use of the discretionary powers that Congress has already provided to the executive branch. This eliminates any anti-immigrat officials from stalling its implementation through the court or other means. It is a significant opportunity for the Biden Administration to deliver protection and relief to immigrant communities as he promised during his campaign. 

We welcome and applaud the Biden administration for designating TPS for Ukraine, Cameroon, Sudan, and Afghanistan and redesignating TPS for South Sudan. The Biden administration is headed in the right direction and must continue on the same path to provide the much-needed TPS to other countries such as Honduras, El Salvador, Nicaragua, Nepal, Venezuela, Guatemala, Ethiopia, Mauritania and other countries.
